Disloyalty Protected Under Free Speech?

A union employee told a newspaper that his employer had “gutted” its engineering staff and had “gaping holes” in its capability. The employer fired him. The National Labor Relations Board (NLRB) held that this was protected free speech under Section 8(C) of the National Labor Relations Act. But, the United States Court of Appeals for the District of Columbia reversed the NLRB’s finding and said that such disloyal statements are not protected under the Act.
