In the Balance
A union election hung in the balance
recently as KDDK attorneys Jon Goldman and Jake Fulcher
went before the National Labor Relations Board to determine
whether one critical vote to bring the union into an
Owensboro
die casting company was valid. The vote was tied 43 for,
43 against and the sole issue was whether one voting
employee
had been terminated because of his support for the union.
While a federal Administrative Law Judge found against
the company, the NLRB in a unanimous decision reversed
that finding and held that the employee was terminated
for failing to properly report his absences. As a result,
the terminated employee’s vote did not count, and the
company stayed union free.
